Terms & Conditions:
The terms and conditions shall be binding among the Company and Dealer and the Member of the TVS Mera FRND Reward Program:
Definitions:
“Dealer”: means either an Authorised Main Dealer or Authorised Dealer-Direct appointed by the Company and as notified on www.tvsmerafrnd.com website. It does not include Authorised Dealers.
“Booklet” means the information and details about the Program, Points, terms & conditions etc as prescribed by the Company for the Member/s herein and provided to them in print form or through online.
“Company”: means TVS Motor Company Ltd having its registered office at ‘Jayalakshmi Estates’ No. 29, Haddows Road, Chennai-600 006.
“Customer” means any Person of Eighteen (18) years of age and above being the owner of Products who purchased the same from the Seller.
“Old Customer” means the Customer who purchased the Product/s on or before 08.09.2015.
“New Customer” means the Customer who purchased the Product on or after 09.09.2015.
“Member”: means the Purchaser of Product/s, who enrolled in the Program.
“Points” means the redeemable reward Points credited to the Member’s card under the Program only after the Member does eligible transactions at a Dealer as provided herein.
“Product”: means the two wheeler motor vehicle manufactured by the Company having the mark ‘TVS’ and its concerned brand applied thereon.
“Program”: means TVS Mera FRND Reward Program organized by the Company.
“Purchaser”: means the purchaser of Product/s from Dealer.
“Seller”: means Dealer, as the case may be, who sold the Product to the Member.
“Services” means the repair/maintenance services to the Products offered by Dealership being warranty period services free of charge and post warranty services on payment of charge,
as the case may be.

The Program applies only to the Member/s. Purchasers who have not enrolled as Members are not eligible to participate in the Program.
2)
The Program shall not apply to any other juristic person other than an Individual
Customer. No company, body corporate, partnership firm, institution or brokers, auto consultants or any person who is in the trade of buying and selling automobiles shall be eligible to participate in the
Program. The Customer who is legally competent to enter into this Program alone shall participate in the Program.
3)
Every Customer, buying the Products at the Dealership notified by TVSM for the Program,
shall at his/her option, eligible to enrol in the Program. Desiring Customer can submit the application form duly filled-in with supporting documents to the Company. On scrutiny of the application, the Company when accepting the application,
will enrol the Customer as a Member in the Program. Mere filing the application form will not entitle the Customer to become the Member in the Program. The Company reserves its rights and discretion to accept or reject
the application without providing any reason. On enrolment, the Customer will become a Member, who is deemed to have read and understood the terms and conditions of the Program.
4)
The details of the Program are prescribed in the Booklet, which is an integral part of the Terms and Conditions buying Products from notified Dealers.
5)
Subject
to the terms and conditions contained herein, the Enrollment is applicable only to Customers buying Products from notified Dealers.
6)
The program is operational from 9th September 2015 in respect of Dealers notified by TVSM in the States of Tamilnadu, Pondicherry, Karnataka & Goa.
7)
The membership is free of cost to the New Customer for a period of three (03) years from the date of enrolment/purchase of Products from the Seller.
The Membership can be renewed for a further period of 3 years subject to payment of Membership fees at such prevalent rates. Details of Membership fee will be available at Dealership or the Company.
8)
Old
Customers who have purchased the Products on or before 8th September 2015 can also enrol and become Member/s of the Program on payment of Membership fees as applicable at the time of enrolment.
1)
Duration of the Membership: The Duration of Membership is initially for a period of three years. Thereafter, the Member is eligible to renew the Membership for further tenure by way of making payment of Membership fees at such prevalent rates.
2) Benefits:
The
Program comprises of Blue, Silver & Gold tier program, the details of each tier program is provided in the Booklet. Members under the Program can earn Points on each of the
following viz.: (i) on their availing Paid services, as applicable, from the Dealership; (ii) on the Member’s repeated purchase of Product/s from Dealership; (iii) enabling Dealer to make sale of Products onthe Member’s referrals. Other
than the aforesaid three activities, Members are not eligible for earning Points. The details of Points earned for various types of transactions under each tier and the upper limits of benefits aregiven in the Booklet. The
procedure and guidelines for earning the reward Points by a Member is detailed out in the Booklet. The reward Points can be redeemed by the Member/s while availing services to the Product/s from Dealership
in the manner as prescribed in the Booklet.
3)
Each activity as described in the Booklet shall have details of eligible Points, accordingly, the Member can earn the Points upon completing the transaction.
4)
The procedures and
guidelines shall be subject to change/revision at any time at the sole discretion of the Company. Each reward Point will be valued by the Company in terms of monetary value at such rate and at such periodical, as the Company will prescribe from time to time. From time to time, the Company will prescribe the allotment of Points earned for each tier of the Program.
5)
Each Member will be provided with a Membership card. The
Membership card is not transferable. The Points earned by the Member shall not be traded or transferred by the Member. The Membership card does not authorize or assure any credit limit or any monetary transaction
thereof. The Membership card is neither a Credit Card nor a Debit card.
6)
The Membership card does not provide the facility of cash withdrawal by the Member at any place.
7)
The Membership card is valid only within
the States of Tamil Nadu, Pondicherry, Karnataka and Goa or such other states as notified by TVSM from time to time.
8)
The Membership card can be used by the Member only at any of the Dealership premises for: (a) earning the reward Points as mentioned above; (b)
redeeming the reward Points as prescribed in program Booklet.
9)
The benefits as prescribed for the Membership under the Program would commence: (i) from the date of purchase of Products (as per the invoice) in case
of New Customer/s; (ii) from the date of Membership in case of Old Customer/s. Customers are not eligible for benefits under the Program from the date of application.
10)
Reward Points would be
credited to the Member’s only, subject to the following conditions that: •• If the Member does the transactions, as prescribed for the Benefits, with Dealerships, as the case may be, in the States of Tamilnadu, Pondicherry,
Karnataka & Goa or such other notified states after the date of issue of the Membership card and during the validity period of the Program. •• No Points are awarded on the amount spent for purchase of New Product/s. Member is eligible for reward
Points only for the transactions as prescribed for the benefits in the Program as mentioned above. •• No reward Points are awarded on the amount spent for the purchase of any Spare Parts. However, spare parts consumed
during the course of Service shall be considered for reward Points as per the rates/structure prescribed in the Booklet. •• On presenting the Membership card to Dealership at the time of settling the bills pertaining to
the prescribed transaction eligible for benefits under the Program.
11)
The Customer who provides all the requisite details in the activation form is entitled to 50 bonus Points.
12)
The Membership Card does not create any
other benefits or privileges to the Member which are not provided in the Terms and conditions.
13)
The Terms and Conditions of the Program is independent of any other terms and conditions between the Member and
Dealer in relation to the Product sales / Services. Members are governed by the terms and conditions applicable for Free Warranty Period Services and Paid Services on chargeable basis inter-se between the Member and Dealer as the case may be. The Terms and conditions shall not alter or vary the: (i) Warranty conditions prescribed for the Product; (ii) Paid Services. 14) Members are
not eligible for earning Points on and from the Insurance Premium paid/payable.
1)
Member is entitled to redeem the Points earned pursuant to the first transaction after the Customer becoming a Member.
2)
Member shall not be entitled to redeem the Points being earned during and from the
transaction.
3)
Points once redeemed cannot be transferred, revoked or cancelled.
4)
No Points can be earned by the Member from the Points redeemed.
5)
Fixed Points are earned by Members for the Services as detailed
out in the Booklet. No relevance can be attributed for earning Points in consideration of the value of or charges paid/spent on the Services availed.
6)
The Member can redeem the earned Points while paying the charges
to Dealership for the Services. However, if the Points earned are not adequate for the total amount of charges payable, the Member has to pay the residue charges after redemption of Points.
7)
The reward Points accrued
during a particular transaction cannot be redeemed against the same transaction.
8)
Members can redeem their earned / accumulated Points available in the Membership account against the
charges payable for the Services, consumables in the Services, Spare Parts, Lubricants, Accessories, Insurance renewal*, Extended Warranty* if any at Dealerships in every successive transactions, as the case may be,
within 3 years from the date of Membership / date of purchase, whichever is earlier. (* Subject to availability)
9)
Members cannot redeem Points against total invoice value. At least Rs.1/- should be paid by the Member.
10)
Any unutilized reward points at the end of 3 years will get lapsed.
11)
Points cannot be redeemed for cash.
12)
In case of any
inadvertent error of computer system in wrong or incorrect deduction of /redemption of Points, the Points incorrectly / wrongly deducted will be reversed after 72 hours.
13)
Redemption of reward Points against the
insurance of Product/s would be subject to rules and regulations of Insurance Regulatory Development Authority (IRDA).
14)
In case the Company finds that the Member’s account has incorrect credit of Points, the
Company has every right to rectify the same by debiting such Points which are incorrectly credited. However, the Company will promptly notify the same to the Member.
1) The offer is valid only on BikeCleanse outlets in Bangalore, Mangalore, Belgaum and Coimbatore. 2) The offer will be live from 29th September ‘17 to 1st 0ctober 2017 3) To avail the offer, register mobile no & SMS (with code) needs to be share at the outlet. 4) Only TVS Motor vehicles are eligible for this offer 5) Selection of customer for offer is completely in discreet of TVS Motor 6) TVS Motor assumes no responsibility for the quality of service, damage of vehicle, duration of waiting period while the offer is being availed 7) TVS Motor or BikeCleanse shall not be liable to provide any refund or relief in the event of the offer not being redeemed during the offer eligible period. 8) This offer is open to only Mera FRND members . 9) This offer can be consumed only once. 10) Any disputes arising out of and in connection with this offer shall be subject to the exclusive jurisdiction of the courts of Bangalore only.
1) The Membership card remains always the Property of the Company. 2) Once the Membership card is issued, the usage is at the sole risk and responsibility of the Member. Member shall ensure that the Membership Card is used by the Member personally or through his/her authorized representative. However, the Company may follow authentication process to ensure Member’s safe usage of the Membership card. 3) Misplacement or loss of Membership card, the Company and/or Dealer shall not be responsible. The Member shall immediately notify the Company and/or Dealer regarding the loss or theft or damage to the Membership Card; on receipt of authentic information from the Member, the Company will immediately block the Membership Account from being redeemed or misused and on satisfactory proof, the Company will consider resuming the account, issuing fresh or duplicate Membership Card to the Member. The Member shall be liable to pay such charges for fresh / duplicate Membership Card as prescribed by the Company from time to time. 4) The applicant for Membership of Program authorizes the Company to use the information provided therein for the purpose of marketing the Company’s Products/services, etc. 5) The Company shall not be responsible for any damaged / mutilated / lost-in-transit / incorrectly filled Applications. In all such cases the applicant would have to reapply for the Program. 6) The Program Membership does not ensure any preferential treatment or additional privileges, other than those schemes / offers as announced for the benefit of the Members from time to time, at Dealership. 7) TVS Motor Company Ltd. reserves the right to withdraw the benefits of the Program on account of the Member’s non-adherence to the program Terms & Conditions. 8) The Members who voluntarily choose to close the Membership can do so by giving fifteen (15) days prior notice to the Company and in such case, the Member can use the benefits for a period of 45 days from the date of closure of Membership, post which period, the said benefits will be withdrawn. 9) In no event the Company and/or Dealer shall be liable for any loss or damages arising out of the Program. 10) Tier movements of Members to be reviewed for downgrading on a periodical basis say 6 months, after adjustment of Points used-up. Upgrade, Point credits & debits will be done instantly. 11) Subject to payment of renewal fee for the renewal of Membership as set out in the terms and conditions herein, the unused Points can be carried forward only when the Company agrees for renewal of Membership after three (3) years. 12) The Member for the purposes of allocation and redemption of Points is acceptable only at select Dealerships in the said States. Should any member move to a city where there is no Dealer activated in the Program, the Company, would bear no responsibility and would not be liable to cover for any loss of benefits that might accrue to the Member in such a case. 13) If any additional Points provided for any specific event or program organized by the Company and/or Dealer during any of the promotions / events organized shall be at the sole discretion of Company. 14) The Company reserves the right to refuse crediting any Points in the Program, when the Company finds that the transactions of the Member is not as per these terms & conditions or is vitiated by fraud, misrepresentation, cheating, forgery or any kind of concealment of facts and / or is done with an intention to bring about / commit the same. 15) If any Member is involved in the business of sales of two wheelers viz. bankers, brokers, auto consultants, etc shall not be eligible for Points for referral sales. However, such Members will be eligible for the Points for the transactions other than referral sales. 16) Transfer of Points amongst Members is strictly not allowed. 17) In the event a Member is selling his/her Product, the Membership will cease to exist and it shall not be transferred to the buyer of Member’s Product. 18) In case, the Member prefers to change his/her registered details (Address, contact telephone number, e-mail id’s etc.), he/she may contact the dealership where the enrolment was done. 19) The Company shall not be liable for circumstances that are beyond its reach or control, which may have caused delay or inability to fulfill requests of the members. 20) The Company shall not, in any way, be liable or under any obligation to the Members if the Program is withdrawn or modified due to statutory enactments, judicial/quasi-judicial orders or any other reasons beyond its control. 21) The Program terms and conditions contained herein all constitute a binding agreement on the TVS Mera FRND member and shall be governed by laws of India. 22) In all matters/disputes arising out of the Application and Terms and Conditions contained herein, the competent Courts in Chennai alone shall have the exclusive jurisdiction to the exclusion of all other Courts. 23) Notwithstanding anything contained, the maximum liability of Dealer and/or the Company shall not exceed Rs. 5000/- (Rupees Five thousand only) 24) The terms and conditions are privy among the Member, Dealer and the Company. 25) Unless otherwise agreed, the Program shall come to an end in any of the following events: (i) on its maturity period of said three years from the date of enrollment of Customer in the Program; (ii) notwithstanding anything contained herein, early termination of Program by the Company by giving 15 days prior notice to the Member; (iii) notwithstanding anything contained herein, early termination of Program by the Member by giving 15 days prior notice to the Company and/or Dealer; (iv) breach of contract; (v) termination due to operation of any law for the time being in force. 26) Member/s shall not draw any assumption/presumption over redemption of Points which are not expressly provided herein. Members are advised to contact the Company for any clarifications over redemption of Points. 27) Member or its successors shall not be entitled to claim any sum from the Company and/or Dealer from unutilized / elapsed Points. 28) Member expressly agrees that in case the Member unclaims any unutilized Points for a period of one year from the expiry of the Program, the unclaimed/unutilized/elapsed Points shall stand transferred to the benefit of the Company. 29) The Member shall be responsible for and liable to bear all the applicable taxes and duties over the Program / benefits flowing from the Points earned by them. 30) Unless otherwise agreed, Member/s are not eligible for any other program or scheme operated by the Company and/or Dealers.
